These Terms of Use (“Terms”) govern your use of leadtree.net (the “Site”), operated by Lead Tree, Inc. (“Lead Tree,” “we,” “us”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

The Site provides general information about Lead Tree’s business-to-business lead brokerage services and a way to contact us. Nothing on the Site is an offer to provide services. Any business relationship between Lead Tree and a publisher or buyer is governed by a separate written agreement, which controls over anything on the Site.

3. Use of the Site

You may use the Site for lawful business purposes. You agree not to:

• use the Site in violation of any law or regulation;
• submit false, misleading, or someone else’s information through our contact form;
• copy, scrape, harvest, or collect content or data from the Site by automated means without our written permission;
• interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems; or
• use the Site to send spam or other unsolicited communications.

When you submit our contact form, you confirm that the information is accurate and that you are authorized to provide it, and you agree to the contact consent shown on the form and described in our Privacy Policy.

Descriptions of our verticals, lead types, and processes are not promises of any particular lead volume, quality, conversion rate, payout, revenue, or other result. Results depend on many factors outside our control and on the terms of any written agreement.

5. Intellectual property

The Site and its content, including text, graphics, the Lead Tree name and logo, and the Site’s design, are owned by or licensed to Lead Tree, Inc., and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to view and use the Site for its intended purpose. You may not reproduce, modify, distribute, or use our content, name, or logo without our prior written permission.

6. Third-party links

The Site may link to third-party websites, such as LinkedIn. We do not control and are not responsible for their content, policies, or practices. Your use of third-party sites is at your own risk and subject to their terms.

7. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, LEAD TREE, INC., AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.

11. Changes and general terms

We may update these Terms from time to time by posting a new version on this page and changing the effective date above. Your continued use of the Site after changes are posted means you accept them. If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver.
